Six consumers have filed a lawsuit against the Monsanto Company alleging that its top-selling Roundup weed killer has been falsely promoted as being uniquely safe when it can actually have severe effects on human gut bacteria that is critical for good health.

What’s the Problem?
June 22, 2017 – The complaint (PDF) alleges that consumers are being deceived by false and intentionally misleading statements made by Monsanto regarding glyphosate, the active ingredient in Roundup. Plaintiffs include residents of Wisconsin, Illinois, California, New York, New Jersey and Florida.
Glyphosate was approved by the U.S. Food & Drug Administration (FDA) in 1974, and is promoted by Monsanto as a herbicide that kills plants by targeting an enzyme not found in humans or pets. The complaint alleges that this statement is false and that research shows glyphosate can target an enzyme found in gut bacteria in people and animals, severely affecting their immune system, digestion, and “even brain function.”
“Defendants repeat these false and misleading representations throughout their marketing, including in video advertisements produced for their websites and YouTube Channel,” the complaint states.
The lawsuit is markedly different from most other Roundup cancer claims in that plaintiffs are not alleging physical injury. Instead, they claim violations of trade and business practices laws, alleging that Monsanto was “unjustly enriched” as plaintiffs purchased and paid for more Roundup products than they would have in absence of the alleged false promotions.
