Having lost its last 2 consecutive bellwether trials, Bayer has an uphill battle in a literal tsunami of litigation currently totaling about 11,200 lawsuits filed over cancer injuries alleged from Roundup. U.S. District Judge Vince Chhabria, who has been overseeing the Roundup multidistrict litigation (MDL 2741) in the Northern District of California, initiated confidential talks as he canceled a third trial scheduled for May 20 that would have followed an $80 million verdict against Bayer last month.

What’s the Problem?
“The parties should propose a mediator,” Chhabria wrote in an order Thursday. “If they cannot agree, the court will appoint someone.”
In lieu of the cancelled trial, the judge said resources are put to more efficient use by organizing the massive caseload before him in the MDL. This entails determining which of the suits should be dismissed, which should be sent to state courts, and remanding other cases to their original jurisdiction.
