The Roundup lawsuit has proceeded differently than an earlier case that played out in the same court, with an initial phase focused on scientific evidence while omitting allegations of corporate conduct by Monsanto representatives. At the conclusion of the initial phase, the 6 jurors were asked by U.S. District Court Judge Vince Chhabria to decide whether Roundup was a “substantial factor” in causing Plaintiff Edward Hardeman’s development of non-Hodgkin lymphoma.

If the jury determines that Roundup caused Hardeman’s cancer, the trial will enter a 2nd stage, where evidence can be submitted regarding Monsanto’s efforts to downplay and even cover up studies allegedly linking Roundup to cancer. If the jury finds Roundup wasn’t the cause of his cancer, the trial will end with a victory for the defense. In the case where jurors are unable to reach a verdict, the result would be a mistrial, and the case could be heard again.
The stakes are huge for Bayer AG, which acquired Monsanto last August for approximately $63 billion, in that bellwether trials are used to gauge how future juries are likely to react to evidence submitted in the litigation. Bayer still faces more than 11,000 Roundup Lawsuits, according to Law360.
Last year, Monsanto was hit with a $289 million verdict in San Francisco Superior Court in a Roundup case outside the MDL proceedings. The state court judge overseeing that case, however, has since slashed the award by more than $200 million.
