Monsanto’s push to split the trial into 2 parts — the first involving scientific questions, the second concerning allegations of alleged wrongdoing by Monsanto — was a gamble that seems not to have paid off, considering the hefty award levied by the San Francisco jury.
The Trial began on Feb. 25, and was overseen by U.S. District Judge Vince Chhabria in federal court in San Francisco. Plaintiff in the case was 70-year-old Ed Hardeman, who claimed that his handling of Roundup on and around his property in Santa Rosa directly contributed to his development of non-Hodgkin lymphoma.

After nearly a week of heated deliberations, a unanimous jury returned the verdict in favor of Hardeman for the first phase, sending the bifurcated trial to its second phase, which lasted 4 days. Deliberations for this portion lasted about a day before the jury again sided with the Plaintiff, finding Monsanto liable on a failure to warn claim, a design defect claim and a negligence claim. The jury awarded Hardeman more than $80 million in damages, including $75 million in punitive damages.
Bayer declined to say whether the bifurcation request was a bad idea, but vowed to fight the verdict. The company also noted that one of the biggest hurdles in fighting personal injury cases at trial is trying to explain its view of “extensive science,” while also ensuring jurors understand the weight they should give scientific studies.
The recent verdict follows another even more massive judgement against Monsanto in the same San Francisco courtroom, in which the jury awarded Dwayne Johnson a whopping $289 million after ruling that Monsanto Roundup caused his cancer. Johnson was so sick that his doctors questioned whether he would even live to see the verdict.
