The jury of 1 man and 5 women reached a unanimous verdict after a full week of deliberations, finding that Roundup caused plaintiff Ed Hardeman’s development of cancer. In doing so, they effectively put an end to the defense’s contention that there was no way to know what caused Hardeman’s cancer.
The decision brought to a close the first phase of a 2-part trial, the initial portion covering questions related to science, the second involving allegations of a coverup by Monsanto regarding what it knew about the cancer-causing potential of glyphosate, the active ingredient in Roundup and the chemical named as the likely causative agent in the lawsuits.
The verdict marks another costly setback for Bayer AG, which purchased Monsanto last August for about $63 billion, but whom had to have seen at least a portion of these woes coming, as the litigation was already in full swing at the time
The case is Hardeman v. Monsanto Co. et al., case number 3:16-cv-00525, and the MDL is In re: Roundup Products Liability Litigation, case number 3:16-md-02741, both in the U.S. District Court for the Northern District of California.
