February 5, 2019 – The deceased, 49-year-old Elaine Herzberg, was hit and killed by an Uber Autonomous Vehicle (AV) last March on Mill Avenue in Tempe, according to BizJournals. Herzberg was not in a crosswalk when the accident happened, though the lawsuit alleges that a paved section of the median near the accident encouraged pedestrian crossing.

What’s the Problem?
The suit furthermore claims that the city of Tempe was negligent when it opened a median on Mill Avenue near the accident scene which contained an X-shaped “brick pathway cutting through the desert landscaping that is clearly designed to accommodate people to cross at the site of the accident.”
The city has since taken out the pavement and replaced it with landscaping, according to the Arizona Republic.
The accident focused a media spotlight on Uber’s Automated Vehicle program, which was shuttered shortly after the accident. Tempe Police released a video of the incident showing the Uber’s human driver watching something while the car was in self-driving mode.
Reports indicated problems within Uber’s AV program in the days leading up to the crash. In November, Uber CEO Dara Khosrowshahi even went so far as to say the company had “screwed up” its self-driving platform.
The complaint alleges that the City of Tempe is liable for Herzberg’s death, and that it owes $5 million each to her husband and daughter.
Plaintiffs recently settled a similar lawsuit against Uber Technologies, the details of which remain confidential.
