What’s the problem?
June 12, 2017 – Roger Wittenberns was booked into Palm Beach County Jail on multiple charges including negligent manslaughter and driving under the influence of alcohol, according to the Sun Sentinel.
Police said Wittenberns and his wife spent about 2 hours drinking on the afternoon of the Sept. 21 crash at City Oyster in Delray, Florida.
A duplicate of Wittenberns’ check showed “3 Long Island Iced Tea, 3 Cosmo, 3 Goose 4oz,” before moving to the bar for another Long Island, a vodka martini and another “Goose 4oz,” according to the police report. The couple’s server confirmed Wittenberns drank at least 3 three Long Island Iced Teas.
When the couple left City Oyster, Wittenberns drove his yellow Lamborghini and his then-girlfriend followed in a yellow Porsche. Wittenberns was going north on Northeast Sixth Avenue when he crashed into a silver Buick Enclave driven by 82-year-old Uber driver J. Gerald Smith.
Blood drawn from Wittenberns less than an hour after the wreck indicated a blood alcohol content (BAC) of 0.15, nearly double Florida’s legal BAC of 0.8, according to the arrest report.
An investigator wrote in the report that Wittenberns had slurred speech and glassy eyes and told police that he had “a couple of drinks.”
“He appeared tired and was unable to keep his eyes open,” the report said.
