What’s the Problem?
July 25, 2016 – The Motion for Transfer was filed July 15, with the proposed jurisdiction named as the Southern District of Illinois. The lawsuits allege that J&J ignored studies which identified an association between its Baby Powder and Shower-to-Shower body powder and ovarian cancer. At least 11 such complaints have been filed in 10 federal jurisdictions, according to court documents. Centralized litigations are currently underway in St. Louis, MO., and New Jersey Superior Court.
In the past several months, juries in 2 bellwether cases sided with the plaintiffs, with substantial monetary awards ($72 million and $55 million, respectively) tied to the outcomes. In a third lawsuit, the jury also ruled with the plaintiff, although no monetary award was provided in the case.
Talcum powder is made from talc, a mineral composed mainly of magnesium, silicon, and oxygen. In its natural form, talc can also contain asbestos – although Johnson & Johnson claims its talcum products sold in the U.S. have not contained asbestos since the 1970s.
Plaintiffs allege that when regularly applied to the genital areas, talcum powder increases the risk of ovarian cancer. Allegations also include that talc particles may travel into the vagina and become trapped in the ovaries. This accumulation of talc may cause inflammation that encourages cancer cells to develop, according to the lawsuits.
