A St. Louis jury awarded $4.14 billion in punitive damages and $550 million in compensatory damages to 22 women and their families after a 6-week trial in July, according to The New York Times. The verdict represented a potential watershed for plaintiffs in talcum powder lawsuits against J&J, as it broadened the company’s liability: the nearly 2 dozens plaintiffs were the first to succeed with a claim alleging ovarian cancer from asbestos-tainted Baby Powder and Shower to Shower talc, a long-running cosmetic brand the company sold in 2012, caused ovarian cancer. The vast majority of plaintiffs claim they developed the disease after years of using the J&J products as a perineal antiperspirant and deodorant.
This is not to imply that J&J is getting its tail kicked in the litigation. On the contrary, at least 3 juries have rejected claims that Johnson’s Baby Powder was contaminated with asbestos or caused plaintiffs’ mesothelioma. Others have failed to reach verdicts, ending in mistrials.
J&J has said it will appeal all such verdicts against it, and maintains that its products are safe to use as directed, even claiming that its Baby Powder is one of the most scientifically-tested products of all-time, and that allegations refuting this amount to “junk science.”
