What’s the Problem?
August 22, 2017 – The verdict marks the largest sum awarded to date in the talcum powder cancer litigation against J&J, according to CNBC.
Plaintiff Eva Echeverria alleged that the company failed to adequately warn about the potential cancer risk with its talcum powder products. Echeverria used Johnson’s Baby Powder almost everyday from the 1950s until 2016, according to the lawsuit.
The $417 million award included $68 million in compensatory damages and $340 million in punitive damages. Evidence in the case included internal documents dating back to the 1970s, which indicated that J&J knew about the risks of talc and ovarian cancer, according to Echeverria’s attorney.
The verdict follows 4 other trials in St. Louis which yielded similar outcomes — with juries awarding damages of $110.5 million, $72 million, $70.1 million and $55 million, for a combined total of $307.6 million.
More than 1,000 other women have filed similar talcum powder ovarian cancer lawsuits. Some who won their lawsuits won much lower amounts, illustrating how juries have wide latitude in awarding monetary damages.
