What’s the problem?
July 11, 2017 – Los Angeles County Superior Court Judge Maren Nelson has convened a 5-day “Sargon” hearing this week, which is the California equivalent of a “Daubert” hearing. A Daubert hearing is where parties argue over which expert witnesses will be permitted to testify in a trial. It will also show the scope of their testimony.
Pretrial hearings like these are often as important as the actual trial. Last October, a New Jersey court judge canceled what was to be the first talcum powder trial in that state. He stopped the trial because of a refusal to permit testimony from experts for the plaintiffs over alleged links between talc and ovarian cancer.
The Sargon hearing precedes what will be the first talcum powder lawsuit to go to trial in California. More than 300 lawsuits filed there allege that J&J and their talc supplier Imerys Talc America had known for decades about the alleged carcinogenic effects of talc.
However, they failed to warn consumers in an effort to maximize profits, according to the lawsuits. J&J insist these studies are based on flawed data.
In 2013, a study published in the Journal of Cancer Prevention Research found that women who applied talcum powder to their groins had a 20-30% increased risk of developing ovarian cancer compared to women who did not use talc products.
J&J knew of these risks and still failed to warn consumers of the danger of talc powder, according to the lawsuits. The company continues to market its baby powder and Shower-to-Shower as safe for use despite the growing body of evidence linking it to ovarian cancer.
