What’s the Problem?
May 3, 2016 – According to the lawsuit, Plaintiff Gloria Ristesund used Johnson & Johnson Baby Powder and Shower to Shower Powder on her genitals for more than 35 years. As a result, she developed ovarian cancer and was forced to undergo a hysterectomy and related surgeries. Her cancer is now in remission, according to the complaint.
Following a 3 week trial in Missouri state court, jurors deliberated for about a day before ruling in favor of Ristesund. Plaintiff was awarded $5 million in compensatory damages and $55 million in punitive damages.
The verdict marks the second straight trial loss for the company, which currently faces about 1,200 additional lawsuits accusing it of not adequately warning consumers about the cancer risk associated with its talc-containing hygiene products. Ristesund’s attorneys said they were gratified by the ruling, and hope the jury’s decision will bring an end to the talcum powder litigation and compel J&J to settle the remaining cases.
The recent trials have sparked renewed interest in talcum powder lawsuits. Plaintiffs in the litigation, which is centered in Missouri and New Jersey state courts, have accused Johnson & Johnson of failing to warn for decades that talc has been linked to an increased risk of ovarian cancer. The company has said it acted properly in developing and marketing the products, and plans on appealing the recent verdicts.
