What’s the problem?
April 12, 2018 – The jury determined that both J&J and Imerys acted with deliberate indifference to the rights of the plaintiff, according to Law360. For punitive damages, the jury ordered J&J to pay $55 million and Imerys to pay $25 million. J&J denied the allegations that its Johnson’s Baby Powder and Shower-to-Shower caused the cancer and said it will appeal.
The case ended in a landmark decision, as it was the first to rule in favor of a plaintiff who alleged mesothelioma from a talcum powder product. Plaintiff Stephen Lanzo III alleged in his suit that Johnson and Johnson was fully aware that its talc products contained asbestos, a known human carcinogen (cancer-causing substance).
“Throughout this trial, we were prevented from presenting evidence which we believe would have been important to the jury in their deliberations,” a spokeswoman for J&J said after the decision. “Once the full evidence is reviewed, we believe this decision will be reversed.”
Lanzo’s legal team disagreed, presenting documents indicating that asbestos had been found repeatedly in J&J talc from the 1960s all the way through the 2000s. The company could have switched to a safer alternative such as cornstarch, but didn’t because of “marketing and litigation concerns,” according to the lawsuit.
