The lawsuit was entered on behalf of Plaintiff Terry Leavitt in Alameda Superior Court in Oakland, and is the first of dozens J&J plans to fight this year, with over 17,000 suits all told. The suit accuses J&J of knowingly selling a dangerous product. J&J maintains that there is no asbestos in its talc, and that Plaintiff’s disease was not caused by the products.

J&J contends that it has decades of studies proving its talcum powder products are safe and asbestos free. Reuters last month published a special report detailing internal documents showing talc in the company’s raw and finished powders sometimes tested positive for asbestos from the 1970s into the early 2000s.
In 11 cases to reach trial so far, plaintiffs have emerged victorious in 3, awarding damages up to $4.69 billion in a July 2018 multi-plaintiff ovarian cancer verdict. J&J won 3 other cases and another 5 ended in hung juries. The company has appealed all of the plaintiff verdicts, and said it is confident the verdicts would be overturned on appeal.
