What’s the Problem?
October 9, 2017 – The complaint, filed in January, alleges that J&J’s cosmetic products were contaminated with asbestos, according to Pasadena News Now. It is the first talcum powder claim filed against Johnson & Johnson to make it to the trial phase; other lawsuits to go to trial have alleged ovarian cancer injuries.
Asbestos lawsuits filed against other manufacturers have resulted in the following verdicts:
In April 2015, a California woman was awarded $13 million in a mesothelioma lawsuit filed against Colgate-Palmolive. The jury ruled that plaintiff Judith Winkel developed the condition as a result of her use of the company’s Cashmere Bouquet talcum powder.
Also in 2015, a New York jury awarded $10.55 million in a wrongful death lawsuit filed against R.T. Vanderbilt.
In 2016, a Los Angeles Superior Court jury awarded Philip Depoian $18 million against talc supplier Whittaker, Clark and Daniels, in what goes down as the largest verdict in the talcum powder mesothelioma litigation.
Verdicts have been rendered against asbestos insulation manufacturers, who were found to have intentionally added the mineral to their products. Complaints against talc companies allege negligence for failing to identify a deadly contaminant and failure to warn about their products’ potential safety risks.
J&J has marketed their talcum powders as safe to use for feminine hygiene; however, studies have linked these products to an increased risk for ovarian cancer, according to the lawsuit.
Based on these findings, and J&J’s failure to warn against the cancer risk, at least 5,500 lawsuits have been filed against the healthcare giant in courts across the U.S.
