The suit was filed by Terry Leavitt with the Alameda Superior Court located in Oakland and is the first in about a dozen J&J talcum related cases which have all been scheduled to face trial in 2019. In total, there are over 11,700 lawsuits against the company with regards to the safety of the talcum in their products.

Joseph Satterley, attorney to Leavitt accused J&J in his statement on Monday, California time, of intentionally retailing harmful products. As reported in an online broadcast released by Courtroom View Network, the evidence will show that J&J was aware of the risk of the asbestos. The evidence points that despite their knowledge, they still went ahead with the retailing of this product, eliminating any opportunity the consumers have to protect themselves from this harm.

When they were reached for a comment, the company’s reply was in the form of a simple sentence: “our talc is safe and does not contain asbestos. For decades, Johnson & Johnson’s Baby powder has repeatedly been tested and been found not to contain asbestos.”

The company has gone ahead, alongside Imerys, to argue that their product has passed several decades of studies and tests, proving that the products were asbestos free.

Since Reuters published a special report that details the internal J&J documents that prove that there was contamination in their talc in December, Leavitt’s case is the first talc case to see trial. According to the Reuters, the documents show that the talc in the raw and processed powders of the company were once ascertained to have tested positively for mild presence of asbestos between 1970 and the early 2000s. the report immediately had a ripple effect to the essence that there was a resultant stock sell off due to fears that J&J would become a liability.
