What’s the Problem?
November 1, 2016 – Plaintiff Deborah Giannecchini said she used baby powder for 45 years before she was diagnosed with ovarian cancer, and that talc contained in the product caused her injuries. She accused J&J of failing to adequately warn about the risk of cancer with talcum powder.
“It’s been a long-fought battle,” she told NBC News after the trial. “I was just elated, so relieved it was over. I felt like I accomplished something. There were happy tears and just joy.”
Giannecchini filed her lawsuit in 2012 after her daughter saw an ad offering legal help for talcum powder users who had developed ovarian cancer.
In addition to the compensation she was awarded, Giannecchini said she hoped J&J would more clearly warn about the potential health risks associated with talcum powder use.
“I hope that Johnson & Johnson will step up and take responsibility and post a warning on their product that says this is not as safe as you may think it is and think about it before you decide to use this product,” she said.
This is the third costly defeat in a row for J&J in lawsuits alleging cancer from its talc-based cosmetic products. In May, a St. Louis jury ordered Johnson & Johnson to pay $55 million in damages to a 62-year-old South Dakota woman who was diagnosed with ovarian cancer after using the company’s talc products for decades. The case is Ristesund v. Johnson & Johnson, Imerys Talc America, Inc. J&J was also defeated in February, and forced to pay a $72 million verdict to the family of a woman who died from ovarian cancer. That case is: Hogans v. Johnson & Johnson.
