What’s the problem?

July 25, 2017 – Plaintiff underwent surgery to repair an incisional hernia with Physiomesh three times – in July 2013, December 2014, and September 2015 – according to the lawsuit. It was during the third procedure that surgeons found the mesh patch had failed to work as expected.

The device showed “fatigue of the mesh resulting in a large incisional hernia and extensive adhesions” which required it to be removed, according to the lawsuit.

Plaintiff claims that ever since he was first implanted with Physiomesh in 2013, he has continued to suffer extreme abdominal pain that has affected his ability to work and perform routine day-to-day activities. He still requires treatment for the pain and complications, and faces the prospect of additional surgeries in the future, according to the lawsuit.

The complaint further alleges that Physiomesh was defectively designed, and created an unreasonable risk of complications including chronic pain, recurrence of hernia, rejection, infection, migration, improper wound healing, inflammation, erosion, and more.

Plaintiff is seeking at least $75,000 in damages, bringing counts of defective design, failure to warn, negligence, breach of warranties, negligent misrepresentation, fraud, unjust enrichment, gross negligence, and more against Ethicon and J&J.

The lawsuit was filed on May 22, 2017, in the U.S. District Court for the Western District of Tennessee, but will likely be transferred to the Physiomesh multidistrict litigation (MDL No. 2782) in the Northern District of Georgia.
