What’s the Problem?
January 9, 2017 – Plaintiff filed the complaint (Case No. 8:16-cv-03502-JDW-JSS) last month in the Middle District of Florida, alleging that she sustained serious injuries as the result of receiving a defective Ethicon Physiomesh Composite Patch (Catalog No. PHY1520V, 15 X 20 cm) during laparoscopic ventral hernia repair in Feb. 2016.
Problems with the hernia mesh forced Plaintiff to undergo revision surgery just 6 months later, when it was discovered that she had an abdominal bulge, recurrent hernia, pain and adhesion. Plaintiff alleges that Physiomesh is not reasonably safe for its intended use, and that risks of the design outweigh any potential benefits.
In May 2016, Ethicon permanently withdrew certain Physiomesh products globally after data showed higher than average recurrence and reoperation rates following laparoscopic ventral hernia repair with the products. Plaintiff in the Florida Physiomesh lawsuit was implanted with one of the hernia repair patches (Product Code PHY1520V) included in the withdrawal action, according to the lawsuit.
The recent case is just one of dozens of similar Ethicon Physiomesh Lawsuits to be filed in courts across the U.S. The first such case is scheduled to go to trial in January 2018 in the U.S. District Court, Southern District of Illinois. That lawsuit is Case No. 3:16-cv-00368-JPG-PMF.
