What’s the Problem?

March 30, 2017 – Plaintiffs in the class action allege that Physiomesh was defectively designed in such a way that makes the hernia mesh prone to contracting, tearing and migrating, which can cause serious health complications including perforation, abscesses, adhesions, infections, and the need for revision surgery.
Health Canada recalled Physiomesh in June 2016 after it was linked to higher than expected rates of recurrence and reoperation compared to other hernia mesh patches. Plaintiffs claims they were not warned about these problems before electing to undergo hernia surgery with the mesh patch.
Ethicon attributed the complications to a “multifactorial issue,” but so far the company has been unable to specify the problem.
One of the plaintiffs in the class action is Jacqueline Deschenes of Laval, Quebec, who suffered ongoing pain after being implanted with Physiomesh. Deschenes had the hernia patch removed in Jan. 2015, but she continues to have serious pain. She says it feels “like a mass” inside her all the time.
As many as 30,000 Canadians may have received Physiomesh, according to the class action.
Ethicon will defend itself in the first Physiomesh hernia patch lawsuit to go to trial in the U.S. next year in the Southern District of Illinois. Plaintiff in the lawsuit, Matthew Huff, suffered an infection that caused significant damage to his abdomen and intestines. He later developed abdominal abscesses and intestinal fistulas from the mesh and required additional surgery, according to the lawsuit.
