What’s the problem?
June 6, 2017 – The Taxotere MDL includes lawsuits filed by cancer patients who claim their hair fell out and never grew back following chemo with docetaxel (the active ingredient in Taxotere). Plaintiffs allege they were never warned about this side effect, which is temporary and reversible with other equally effective cancer treatments.
MDL 2740 was created in October 2016 with just 33 lawsuits in the U.S. District Court, Eastern District of Louisiana. Over the next 3 months, the number ballooned to nearly 800 cases, and now includes more than 1,100 hair loss lawsuits.
Approved by the FDA in 1996, Taxotere is an IV medication used to treat breast cancer, non-small lung cancer and prostate cancer. The drug has numerous potential side effects including low blood cell count, allergic reactions, fluid retention, gastrointestinal complications and hair loss.
“In most cases normal hair growth should return,” the Taxotere Prescribing Information (PDF) states. However, “In some cases (frequency not known) permanent hair loss has been observed.”
According to a May 12 joint report, there were at least 1,116 cases pending in MDL 2740. Court documents indicate that 3 companies that were initially listed as defendants have been dismissed.
One of the earlier defendants, Apotex Inc., submitted proof that it had never manufactured docetaxel (the active ingredient in Taxotere). The other entities, Northstar RX LLC and Eagle Pharmaceuticals Inc., proved that they didn’t manufacture docetaxel until after the treatments alleged by individual complainants.
The next general status conference for Taxotere MDL committees is scheduled for July 7, 2017.
