What’s the problem?
April 18, 2017 – The Taxotere MDL has increased in size by at least 150 lawsuits since this time last month, according to an update (PDF) issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on Monday.
All Taxotere hair loss lawsuits that were filed on the federal level have been consolidated in the Eastern District of Louisiana for pretrial handling. Multidistrict litigations are often created in complex pharmaceutical litigation in which a large number of lawsuits involving similar injuries are filed against the same defendant. Consolidation is intended to reduce duplicative discovery, avoid conflicting rulings by different judges, and to streamline the litigation process for all parties.
May could be a pivotal month for the Taxotere MDL. The Court has scheduled a “Science Day” for May 3, at which time the parties will have the opportunity to apprise the Court of the medical and scientific issues central to the cases.
The Court will next convene the first of 2 meetings with Plaintiffs and Defendants Settlement Committees. A follow-up meeting will be held on May 12, after the MDL’s regularly-scheduled status conference.
The settlement committees were established with the goal of engaging the parties in settlement discussions. The attorneys serving on the committees have been instructed not to partake in discovery or other activities which could distract them from their goal of finding a resolution for some or all of the cases.
