What’s the Problem?
March 15, 2017 – The U.S. Judicial Panel on Multidistrict Litigation (JPML) clarified the scope of the Taxotere litigation in a letter written Jan. 4, 2017. The panel explained that the MDL will include cases against generic manufacturers, as well as the maker of name-brand Taxotere, Sanofi S.A.
JPML said the litigation included docetaxel in its formal title, suggesting the MDL involves complaints against both the generic and brand-name forms of the drug. The panel’s letter was in response to District Judge Kurt D. Engelhardt, who wrote to the panel for clarification in December.
At least 755 Taxotere lawsuits are currently pending in the MDL, alleging that Sanofi marketed Taxotere as superior to other chemo treatments, despite having knowledge that it could cause permanent hair loss.
Taxotere was approved by the U.S. Food & Drug Administration (FDA) in 1996; however, it wasn’t until Dec. 2015 that a warning about permanent hair loss or “alopecia” was added to the drug’s labeling.
While temporary hair loss is a common side effect of chemo, plaintiffs allege that Taxotere is more likely to result in permanent alopecia compared to other equally effective cancer drugs. While Sanofi did warn about the potential for permanent hair loss overseas, the U.S. labeling only included a generic warning that “hair generally grows back,” according to the lawsuits.
