What’s the Problem?
March 30, 2017 – The Taxotere Science Day is intended to provide a sort of tutorial so that the court can learn more about the case and the science involved. Cross-examination is forbidden, and the transcript of the proceedings is not shared with the parties, according to a Pretrial Order (PDF) issued Friday.
Science days have been increasingly used in complex pharmaceutical litigation. The sessions represent the first chance the parties and their experts have to influence the Court. As such, attorneys and their expert witnesses should have a fairly refined theory of the case already developed, and be prepared to be as persuasive as possible while staying within the bounds of non-adversarial discourse.
Taxotere is primarily used to treat breast cancer; however, it is also commonly prescribed for non-small cell lung cancer, prostate cancer, stomach (gastric) cancer and head/neck cancer. The drug works by interfering with the growth and spread of cancer cells in the body.
Temporary hair loss is a common side effect of chemotherapy; however, lawsuits claim that some cancer patients experienced permanent hair loss or “alopecia” after undergoing chemotherapy with Taxotere.
In October, a panel of federal judges transferred 89 Taxotere lawsuits to the U.S. District Court for the Eastern District of Louisiana to be coordinated as part of a multidistrict litigation. The Honorable Kurt D. Engelhardt has been selected to preside over the newly-coordinated Multi-District Litigation (MDL). As of mid-February, there were at least 755 Taxotere lawsuits pending in the litigation.
