What’s the Problem?
February 23, 2017 – As alleged in the motion for transfer, each of the Stryker V40 LFIT lawsuits present common claims arising under product liability laws and each present a common set of facts, namely that each plaintiff:
- Was implanted with an LFIT V40 Anatomic Femoral Head;
- Was injured due to failure of the product, and
- Alleges the same negligent and/or egregious conduct by Stryker.
Plaintiffs further allege that Stryker Corp. knew for years that the LFIT V40 femoral Head was defective and dangerous, but instead chose to downplay potential risks of the device and failed to warn the public and medical community. Additionally, plaintiffs contend that the components were defectively designed, resulting in serious and significant injuries to consumers.
Stryker opposes consolidation because “[p]laintiff cannot meet the heavy burden to demonstrate that transfer of a small number of individual actions involving a myriad of different products, circumstances, and injuries into an MDL is appropriate,” according to a 20-page opposition brief filed with the JPML. “The request is premature—only a handful of cases are implicated in the current motion and only a fraction of those involve products subject to the August 2016 recall upon which Plaintiff relies.”
Plaintiffs recommend the District of Massachusetts for the proposed MDL because it provides an easily accessible location, can handle the large number of cases expected, and because it has very experienced judges. The consolidation will help reduce duplicative discovery, avoid conflicting rulings by different judges, and expedite the litigation process, according to plaintiffs.
