What’s the Problem?
May 16, 2017 – Nearly all eligible patients have registered for an expanded hip replacement settlement program offered by Stryker over the 2012 recall for its Rejuvenate and ABG II Modular-Neck hip stems.
The company has indicated that most payments will be made by the end of this year; however, the exact timing and amount of each payment will vary depending on factors specific to each case, according to a press release issued by Stryker on May 8.
Stryker in July 2012 issued a nationwide recall for its Rejuvenate and ABG II modular-neck hip stem components amid a high number of reports of fretting and corrosion at the modular neck junction. Consumers who received the devices had complained of pain, swelling, local tissue reactions and early failure of the implant, according to Stryker.
The Stryker Rejuvenate Modular Hip System was approved by the FDA in February 2009. While such devices are designed to last up to 20 years, the Rejuvenate was removed from the market less than 2 years after being introduced.
In November 2014, Stryker announced a $1 billion hip replacement settlement to resolve the majority of its Rejuvenate litigation. However, the original agreement only covered patients who had undergone revision surgery for a recall-related reason before Nov. 3, 2014. The new settlement was announced in December, and expanded to include Rejuvenate and ABG II patients who had a recall-related revision prior to Dec. 19, 2016.
