What’s the Problem?

Under Pennsylvania law, the women had 2 years to file a personal injury lawsuit, and 4 years to file for breach of warranty. Bayer and several plaintiffs were conflicted as to the exact timeframe in their particular cases, based on when the women linked their side effects to Essure birth control, and when they brought the complaint.

One plaintiff in the class action said she got pregnant shortly after receiving Essure; Judge John Padova allowed her to pursue her allegations that Bayer downplayed and even actively concealed the risk of pregnancy with Essure. Padova made the ruling on Bayer’s motion on February 11.

Bayer took Essure off the U.S. market in Dec. 2018. Several months earlier, the Food & Drug Administration (FDA) put restrictions on sales of the Essure device, after receiving numerous complaints from women who reported severe health problems after being implanted with the contraceptive.
