What’s the problem?

November 22, 2016 – Bayer filed a motion last month to have the Essure lawsuit — Jacqueline Alexander et al. v. Bayer Corp. et al. — removed from state court to a federal jurisdiction; however, U.S. District Judge Michael Fitzgerald ruled last week that the case will be heard in Los Angeles County Superior Court.
“There’s an economy of working on those cases at the same time in the same way,” Fitzpatrick said in the ruling. “It allows some control by the plaintiffs over the speed at which things are done.”
Essure is a permanent, non-surgical sterilization procedure originally developed by Conceptus Inc., a subsidiary of Bayer AG. The contraceptive is inserted into each of a woman’s fallopian tubes during a transcervical procedure, which forms a natural barrier that keeps sperm from reaching the egg.
However, according to May 2015 article published in the New York Times, Essure has been linked to more than 4,000 adverse event reports submited to the U.S. Food & Drug Administration (FDA). These injuries included severe back / pelvic pain, heavy menstrual periods, and coils that pierced recipients’ fallopian tubes and became lodged in other organs.
A California judge last month ordered that dozens of lawsuits filed by over 900 women in the state alleging complications from the Essure will be centralized in Alameda County Superior Court. The complaints will be heard together as Judicial Council Coordinated Proceedings (JCCP), which will facilitate efficient adjudication and coordinate efforts on behalf of the plaintiffs, according to Superior Court Judge Winifred Y. Smith.
