What’s the Problem?
April 20, 2018 – A New Jersey state jury on April 12 hit medical device manufacturer C.R. Bard Inc. with a $33 million verdict in a lawsuit filed over the company’s allegedly defective pelvic mesh implants, according to CVN. The following day, the same jury returned a punitive damages verdict of $35 million, bringing the total to $68 million.
The jurors ruled that Bard’s Avaulta Solo Support and Align Trans-Obturator Urethral Support Systems, which Plaintiff Mary McGinnis had implanted to treat her pelvic organ prolapse (POP) and stress urinary incontinence (POP), were defectively designed and left her suffering from chronic pain.
Bard denied McGinnis’ allegations, claiming that its pelvic mesh products were extensively tested, and that the plaintiff’s injuries were the result of other pre-existing medical issues. Both the Avaulta and Align implants were removed from the U.S. market in 2012 and 2016, respectively.
The lawsuit is: Mary McGinnis and Thomas Walsh McGinnis v. C.R. Bard Inc., et al., case number BER-L-17543-14.
