What’s the Problem?
January 11, 2017 – The lawsuit was filed on behalf of Plaintiff Sharon Carlino, who suffered adverse health complications after receiving an Ethicon transvaginal mesh patch.
According to court records, Carlino was implanted with the vaginal mesh in 2005 during a hysterectomy, and began to feel something “sharp” around her vagina two years later. She learned that the mesh had eroded into her vagina.
Carlino had surgery to partially remove the eroded transavaginal mesh, but her pain came back in 2010 and she required a second revision surgery in an attempt to remove more of the device. Two years later, she again began to experience sharp pain from her eroded mesh, and to this was added extreme pain during sex, a condition known as dyspareunia.
Plaintiff alleged that J&J marketed its transvaginal mesh as safe and effective, despite receiving numerous complaints to the contrary. The Philadelphia jury determined that neither Carlino nor her doctor were adequately warned of the risks of transvaginal mesh placement, and they supported her doctor’s statement that he never would have implanted his patient with Ethicon mesh had he been aware of these risks.
Carlino sought compensation for her physical pain and suffering, permanent injury, mental and emotional anguish, and financial losses. Her husband also demanded compensation for loss of consortium. After a 2 week trial, Plaintiff was awarded $3.25 million in compensatory damages and $10 million in punitive damages. Her husband was awarded $250,000, and a subsequent amount of approximately $240,000 was included as delay damages.
