What’s the Problem?
February 5, 2018 – In an Order issued Thursday by the U.S. Judicial Panel on Multidistrict Litigation (JPML), all federal Onglyza and Kombiglyze XR heart failure lawsuits will be transferred to the U.S. District Court, Eastern District of Kentucky, for pretrial coordination to be overseen by the Honorable Karen K. Caldwell.
Onglyza (saxagliptin) was approved by the U.S. Food & Drug Administration (FDA) in July 2009 for the treatment of type 2 diabetes, or diabetes mellitus. Kombiglyze XR (saxagliptin and metformin) was approved the following year.
The litigation surrounding the 2 drugs was kicked off in response to an April 2016 enforcement action by the FDA which required manufacturers of saxagliptin-containing diabetes drugs to update their products’ labeling about an increased risk of heart failure. The action followed publication of clinical trial data which linked saxagliptin to a 27% increased risk of heart failure, and an overall higher risk of all-cause mortality.
Plaintiffs in the lawsuits allege that manufacturers failed to adequately warn of the heart failure risk with the drugs, and neglected to recall their products when a host of other safer diabetes treatments are widely available.
