A man claiming that side effects of the diabetes medicine Onglyza caused him to suffer heart failure has requested that a multidistrict litigation (MDL) be created for the pretrial handling of his claim and others like it.

What’s the Problem?
November 1, 2017 – The plaintiff last month filed a petition with a panel of federal judges requesting MDL status, indicating that at least 40 lawsuits have been filed alleging heart failure from Onglyza and a similar diabetes drug, Kombiglyze XR.
“Though filed in different jurisdictions within the federal court system, these cases are closely related: they share the same Defendants, the same basic theory of liability, and the same basic factual allegations,” Plaintiff said in the petition. “All the cases will involve the same core discovery, fact witnesses, and experts. Moreover, none of these cases have made any substantial progress toward trial, making this the ideal time to order transfer.”
Plaintiff has proposed the Northern District of California for the venue of the MDL, noting that at least 2 lawsuits have already been filed there. One of the defendants is also based in San Francisco, the petition states.
In 2013, The SAVOR trial found a 27% increased risk of hospitalization for heart failure among type 2 diabetes patients treated with Onglyza. The findings were reported at the European Society of Cardiology Meeting, and later published in the New England Journal of Medicine (NEJM).
Signs and symptoms of heart failure may include:
- Shortness of breath (dyspnea)
- Swelling (edema) in the legs, ankles and feet
- Rapid or irregular heartbeat
