What’s the problem?

April 30, 2018 – The explosion occurred when metal from some of the other items plaintiff was carrying in his pocket interacted with the battery in a way that caused a short, leading to what’s known as a “thermal runway,” according to the lawsuit.

Plaintiff described the battery as a “flame thrower” as it ignited and burst into flames, causing chemical and thermal burns to his left leg and hands, which required multiple skin grafts to heal.

The U.S. Navy banned e-cigarettes from its vessels in April 2017 after several reports of exploding vapes injuring sailors. A year earlier, The Department of Transportation (DOT) prohibited airline passengers from carrying portable electronic smoking devices in checked baggage, and from using or charging the devices aboard aircraft.

Plaintiff in the Kansas suit has filed a products liability lawsuit against the vape shop where he purchased the battery, as well as the distributor, VapeUSA Corp, for at least $75,000 in damages. He claims the companies failed to adequately warn about the risks associated with e-cig batteries, and did not advise consumers not to carry them in their pockets.
