Two neVapew lawsuits filed over injuries allegedly caused by exploding e-cigarettes have been filed in Florida.

What’s the problem?

November 30, 2016 – James Dardini claims he was severely burned by an e-cigarette that exploded in his front pocket shortly after he arrived to work in Clermont, Florida. Dardini is suing the distributor, Georgia-based KangerTech, and Sunshine Vapor, the store that sold him the device.

Another lawsuit filed in the same court alleges that north Florida resident James Lauria suffered extensive burns to his mouth, face and hand when his e-cig exploded in July 2015. He is suing The Vapor Master in Destin, Florida, Texas-based Nitecore Store and E-commere distributor Uvaper LLC.

Unfortunately, injuries like those suffered by Dardini and Lauria are not uncommon. According to ECigOne.com, at least 204 e-cigarette explosions have been reported in the media. Of these:

  • 56 e-cigarette explosions happened during use.
  • 78 e-cigarette explosions happened during charging.
  • 39 e-cigarette explosions happened during transport, storage or unknown circumstances.
  • 31 e-cigarette explosions involved spare batteries for removable battery mods.

Defendants in the Dardini lawsuit have filed a motion to dismiss, claiming buyers are warned against using vapes while driving long distances, in extreme temperatures and other adverse conditions. The Lauria case was just filed in mid-November, so the defendants’ attorneys haven’t yet responded to the charges.

Neither lawsuit states an amount the plaintiffs are seeking, beyond the statutory minimum of $15,000 for a state court civil case. The complaints seek a court judgment against the defendants, in addition to various damages and costs.
