What’s the Problem?
July 10, 2017 – Plaintiff Dennis Determan lived near manufacturing facilities owned by the Rust-Oleum Corporation and Turtle Wax, Inc. at the Wood River Refinery from April 1991 to 2011, according to the lawsuit.
Determan claims that he was diagnosed with AML in March 2017 due to exposure to benzene emitted from the plants. As a result of his injuries, Determan claims he incurred medical bills, life-long medication and a reduced life-expectancy, according to the lawsuit.
Plaintiff alleges that Rust-Oleum and Turtle Wax failed to adequately test, monitor, and research the effects of benzene on residents living near where the chemical is being used. Additionally, the suit contends that the companies failed to warn residents of surrounding communities of the harmful effects of benzene chemicals and failed to recall and/or cease using benzene and benzene-containing products.
Determan is requesting a trial by jury and damages of at least $50,000, as well as any further relief the court deems just and proper.
The lawsuit is: Madison County Circuit Court case number 17-L-872.
