Federal lawsuits alleging kidney damage and ketoacidosis from the diabetes drugs Farxiga and Xigduo XR have been consolidated into a multidistrict litigation (MDL) in the Southern District of New York.

What’s the problem?
April 12, 2017 – At least 18 federal lawsuits have been filed to date over Farxiga and Xigduo XR, according to a Transfer Order (PDF) issued Thursday.
Plaintiffs requested centralization in February, saying it would promote judicial efficiency and serve the best interests of all parties involved in the litigation. The U.S. Judicial Panel on Multidistrict Litigation (JPML) agreed.
“The actions share factual questions arising from allegations that taking Farxiga or Xigduo XR may result in patients suffering kidney related-injuries, such as diabetic ketoacidosis and kidney damage,” the order states. “The actions thus implicate numerous common issues concerning the development, manufacture, testing, regulatory history, promotion, and labeling of the drugs.”
MDLs are common in complex product liability litigation in which many similar claims are filed against the same defendant. Consolidation is intended to reduce duplicative discovery, avoid conflicting rulings by different judges, and to expedite the litigation process.
In May 2015, the U.S. Food & Drug Administration (FDA) issued a Drug Safety Communication indicating that type 2 diabetes medications from the SGLT2 inhibitor class had been linked to diabetic ketoacidosis (also known as DKA, diabetic acidosis or ketoacidosis), a potentially fatal condition that occurs due to a buildup of toxic ketones in the blood. Later that year, FDA required the labeling of all SGLT2 inhibitors to be updated with information about the ketoacidosis risk.
Last year, JPML ordered the creation of a separate MDL for lawsuits in involving Invokana and Invokamet, SGLT2 inhibitors that have been linked to the same side effects as Farxiga and Xigduo XR. More than 120 cases are currently pending in that litigation.
