What’s the Problem?
February 22, 2017 – The request was filed earlier this month in a motion to transfer (PDF) with the U.S. Judicial Panel on Multidistrict Litigation (JPML). All of the lawsuits were filed on behalf of plaintiffs alleging injuries from Farxiga including diabetic ketoacidosis (DKA), kidney failure and heart attacks.
Multidistrict litigations are common in cases where multiple lawsuits are filed over the same drug. Consolidation is designed to eliminate duplicative discovery, conflicting rulings by different judges, and to serve the convenience of all parties involved in the litigation.
Farxiga belongs to a class of medications called sodium-glucose cotransporter-2 inhibitors (SGLT2 inhibitors) that work by helping the kidneys eliminate glucose from of the blood. Farxiga was developed in a partnership between AstraZeneca and Bristol-Myers Squibb, and was approved by the U.S. Food & Drug Administration (FDA) in January 2014.
According to the motion for transfer, there are now at least 18 Farxiga lawsuits pending in 6 different federal district courts, with plaintiffs attorneys expecting many more complaints to be filed in the coming weeks and months. Given the drugmakers’ unwillingness to informally coordinate the cases, the motion indicates that a separate MDL should be established.
“Each of these Actions arise from the same or similar operative facts and wrongful conduct alleging that, as a result of ingesting Farxiga, Plaintiffs have suffered sudden onset of life-threatening diabetic ketoacidosis (often in the setting of normal blood glucose levels), and/or acute renal failure, and/or pyelonephritis (kidney infection) and/or urosepsis and continue to suffer from the sequelae of these injuries,” the motion states. “All of these injuries were the subject of recent FDA safety advisories.”
