What is the Zimmer Persona Knee Replacement?

Zimmer introduced its Persona Knee System in late 2012 as a “new era of personalization” for artificial knee replacements, and as the “… most clinically successful knee replacement more personalized than ever.”

Why Did the FDA Approve the Zimmer Knee?

The Zimmer Persona Trabecular Metal Tibial Plate was fast-tracked to market via the FDA’s 510(k) approval loophole, which approves medical devices that are “substantially equivalent” to existing devices. When manufacturers apply for 510(k) approval, they are not required to conduct clinical trials which would (or would not) show the device is both effective and safe.

Why was the Persona Knee Recalled?

The Zimmer Persona porous coated, uncemented Trabecular Metal Tibial Plate was recalled by Zimmer on March 12, 2015, and categorized as an FDA Class II recall. Zimmer initiated the recall after the device was linked to numerous reports of problems that could lead to revision surgery.

What Complications have been Linked to the Zimmer Knee?

Total knee replacements are expected to last from 15 to 20 years, but Zimmer Persona knee devices have been reported to fail within just a few years of being implanted. Lawsuits have been filed on behalf of patients who experienced the following complications:

  • Knee Pain
  • Knee Replacement Loosening
  • Lack of Artificial Knee Fixation
  • Device Failure
  • Need for Revision Surgery

Has a Class Action Been Filed?

No class action lawsuit has been filed in the Zimmer Persona litigation. All lawsuits being filed are done so on an individual basis.

What Damages Could I Be Awarded?

If our lawyers find that you have a legitimate claim against Zimmer for a defective knee implant, you could be entitled to compensation to assist with medical expenses, lost wages, pain and suffering, and other damages.

Have There Been Any Settlements?

The problems with Zimmer Persona knees only recently surfaced, and there have been no reports of the manufacturer offering settlements. However, as more injured parties come forward to file claims, the likelier it is that Zimmer will be forced to settle some or all of the cases.

Is There a Time Limit to File a Claim?

Yes. Each state imposes a specific statute of limitations (SOL) regarding deadlines for filing lawsuits over allegedly defective medical devices. If you fail to act and miss your state’s SOL, you will be unable to be compensated for your injuries.
