What’s the Problem?

March 27, 2017 – According to the lawsuit, Plaintiff Cheryl Lear was prescribed Prilosec from March 2012 to September 2013, and Protonix (generic: pantoprazole) from February 2013 through September 2013. Both drugs were issued in prescription strength to relieve symptoms of GERD.
For approximately 3 years Lear suffered from kidney damage, but at the time her injuries were not attributed to her use of a proton pump inhibitor (PPI) because manufacturers failed to adequately warn about the risk of kidney disease with the medications. Instead, she claims the defendants misled her to believe that Prilosec and Protonix were both safe and effective to treat GERD.
“The injuries and damages sustained by Plaintiff; CHERYL LEAR, were caused by Defendants’ Prilosec and Protonix and their unlawful conduct with respect to their design, manufacture, marketing and sale,” the complaint states. “As a result of Defendants’ failure to warn and/or concealment of its knowledge that their Prilosec and Protonix caused kidney injuries, such as the one suffered by Plaintiff Cheryl Lear, Chery Lear did not discover, nor did she have reason to discover, their wrongful conduct as alleged herein until July 2016.”
Lear is not alone in her allegations of kidney damage from PPIs. In October, plaintiffs requested that a multidistrict litigation (MDL) be established for all such lawsuits filed on the federal level. However, the petition was denied last month a panel of judges determined that there were too few pending cases to warrant consolidation, and suggested that inclusion of competing pharmaceutical companies and multiple drugs would complicate case management.
