FDA warned March 14, 2025 against inhaling nitrous oxide in any size canister, tank, or charger, stating inhalation causes serious adverse health effects including death. [1] FDA observed increased adverse event reports after nitrous oxide inhalation. [1]

Affected Products and Brands

Products are sold under multiple brands: Baking Bad, Cloud 9ine, Cosmic Gas, Euro Gas, ExoticWhip, FastGas, Galaxy Gas, Goo Sticks, HOTWHIP, InfusionMax, MassGass, Miami Magic, Monster Gas, NITROX, and Whip-it! The products come in flavored and unflavored canisters marketed as food processing propellant for whipped cream.

Retailers include Amazon.com, eBay, Walmart, smoke shops, vape shops, and gas stations. Manufacturers market products “for culinary use only” while selling in colorful packaging with sweet and fruity flavors targeting youth.

Severe Health Effects

Inhalation causes abnormal blood counts, asphyxiation, blood clots, frostbite, headache, impaired bowel and bladder function, lightheadedness, limb weakness, loss of consciousness, numbness, palpitations, paralysis, tingling, trouble walking, and vitamin B12 deficiency. Death occurs in some cases.

Regular users experience prolonged neurological effects including spinal cord or brain damage continuing after stopping use. Nitrous oxide cuts off oxygen to the brain and causes dangerously low blood pressure leading to fainting and injuries.

Youth Targeting Through Marketing

Manufacturers package products in bright colors with flavors like strawberry cream, tropical punch, and vanilla cupcake. Social media videos show teenagers inhaling from canisters, creating a popular subgenre on TikTok, X, and YouTube.

Over 13 million Americans misused nitrous oxide in their lifetimes according to the 2023 National Survey on Drug Use and Health. Teens are especially vulnerable as their brains are still developing, making them more susceptible to harmful effects.

Deceptive Marketing Practices

Companies market products as “food processing propellant for whipped cream and culinary food use” while designing packaging and flavors appealing to recreational users. Disclaimers state “for culinary use only” while featuring accessories, branded merchandise, and high-volume inhalation doses.

Product Liability Claims

Manufacturers selling products designed for recreational inhalation while claiming culinary purposes face strict liability. Products marketed with knowledge of foreseeable misuse creating unreasonable dangers trigger liability without proof of negligence.

Failure to Warn

Manufacturers knowing products are inhaled recreationally must provide adequate warnings about neurological damage, brain injury, and death risks. Disclaimers stating “for culinary use only” are insufficient when packaging, flavoring, and marketing target recreational users.

Negligent Design

Designing products in bright packaging with candy flavors and high-volume doses demonstrates intent to facilitate recreational use. Manufacturers breached duties to design products preventing foreseeable misuse.

Fraudulent Misrepresentation

Marketing products as culinary propellants while targeting recreational users constitutes fraudulent misrepresentation. Companies profit from recreational sales while claiming compliance with food processing regulations.

Personal Injury Claims

Individuals suffering neurological damage, brain injury, spinal cord damage, psychiatric disorders, or vitamin B12 deficiency from nitrous oxide inhalation may recover medical expenses, lost wages, permanent disability costs, and pain and suffering. Brain and spinal cord damage often require lifelong care.

Wrongful Death Claims

Families of individuals who died from nitrous oxide asphyxiation may pursue wrongful death litigation for funeral expenses, loss of companionship, and punitive damages. Deaths from products marketed to encourage dangerous use warrant maximum compensation.

Parental Claims

Parents of minors injured by nitrous oxide products may claim damages for medical expenses, emotional distress from discovering children injured, and costs of ongoing neurological treatment. Youth-targeted marketing increases manufacturer liability.

Punitive Damages

Marketing products with candy flavors and bright packaging to encourage recreational use despite known death risks supports punitive damages. Profiting from dangerous products while disclaiming responsibility demonstrates reckless disregard warranting punitive awards.

Platform Liability

Amazon, eBay, and Walmart’s role distributing products may create platform liability. E-commerce sites facilitating sales of products designed for dangerous misuse face potential responsibility for injuries.

Contact an Attorney

If you or your child suffered neurological damage, brain injury, or other harm from nitrous oxide inhalation, contact a product liability attorney. Preserve product packaging, purchase receipts, and medical records documenting injuries.
