What’s the Problem?
July 15, 2017 – Plaintiff in the case argued that her son was born with spina bifida as a result of her use during pregnancy of Depakote, a bipolar treatment drug manufactured by AbbVie Inc.
The complaint stated that AbbVie failed to provide adequate warning about the risks of taking the medication during pregnancy. While jurors did not award punitive damages in this case, this is hardly the first time Depakote has been the subject of controversy in regards to its potential side effects.
Back in 2012, when Depakote was owned by another company named Abbott Laboratories, that company had to pay out $1.6 billion for promoting the medication for unapproved or “off-label” uses. There are currently more than 600 lawsuits alleging birth defects from Depakote pending in state and federal courts across the U.S.
The $15 million award will hopefully allow the plaintiff’s son to receive the best medical care available for the rest of his life.
A crucial piece of evidence came in the form of internal corporate memos, which suggested that AbbVie executives knew that the findings of medical studies conflicted with the risk assessment printed on the labeling of Depakote, according to Bloomberg Technology. One of the families’ attorneys told jurors during closing arguments that it was common knowledge that top-tier management for AbbVie was well aware of its severe health risks, and that the risks printed on the drug’s label were inadequate.
