What’s the Problem?

April 11, 2017 – Judge Stack’s initial role will include looking over the parties’ objections to deposition designations and then make recommendations and reports to the court on those. These duties may be expanded to include additional assignments before the start of next month’s trial, according to U.S. District Judge Nancy J. Rosenstengel.
During his 24 years as an Illinois circuit judge, Judge Stack served as special master in multidistrict litigations involving Yaz, Yasmin, and Pradaxa.
Stack also presided over the first trial in the Midwest involving the painkiller Vioxx (generic: rofecoxib), which was recalled in September 2004 after studies linked the drug to a doubled risk of heart attack and stroke in patients who took it for at least 18 months.
In the upcoming Depakote birth defects lawsuit, Plaintiff Michelle Leal claims that her use of the drug during pregnancy caused her son to be born with spina bifida, a severe defect in which the spinal cord fails to develop correctly in the womb. Abbott claims that Depakote labels featured an all-caps warning about the risk of birth defects.
The case was originally chosen as a bellwether trial scheduled to begin last June. However, the month before the trial was supposed to begin, Abbott filed a motion seeking to exclude the testimony of physician Olaf Bodamer concerning the child’s behavioral problems and cognitive impairment, saying it was too speculative.
