Latest Updates

The CPSC announced Recall No. 20-061 on January 29, 2020, alongside simultaneous recalls of inclined sleepers from Summer Infant, Graco, and Evenflo — a coordinated action covering more than 165,000 units across all four companies [1]. Consumer safety advocates noted that inclined sleepers had been linked to at least 73 infant deaths since the products were introduced, and called on the CPSC to ensure the recalled units were removed from homes and daycare centers nationwide [2]. No deaths or injuries specific to the Delta product had been reported at the time of the recall, but the CPSC stated that infant fatalities had been reported with other manufacturers’ inclined sleep products and that the hazard mechanism was the same across all recalled models [3].

The Suffocation Hazard in Inclined Sleepers

Inclined sleepers position infants at an angle steeper than 10 degrees — a design that was marketed as soothing and beneficial for newborns but that pediatric safety science has established is incompatible with safe infant sleep. When an infant falls asleep in an inclined seat, the head can slump forward and compress the airway, or the infant can roll from back to side or stomach, pressing the face into the padded seat surface.

Newborns and young infants cannot reposition themselves when an airway obstruction develops, and a sleeping or inattentive caregiver may not detect the danger before it becomes fatal. The American Academy of Pediatrics’ safe sleep guidelines have long required a firm, flat surface at no more than a 10-degree incline — a standard these products did not meet.

Sold as a Sleep Product — Marketed to New Parents

The Delta Children 3-in-1 Activity Rocker, Feeder and Sleeper was designed and sold with “sleeper” as one of its three named functions, directing parents to use the inclined seat as a sleep surface for their newborn. The product’s own name — and its marketing to parents of the youngest, most vulnerable infants — made the risk greater, not lesser, because it gave families an explicit manufacturer endorsement to use the product in exactly the way the CPSC later determined was dangerous.

A parent who read the product name, purchased it at a major retailer, and placed their newborn in it to sleep had no reason to believe the product posed any risk — the name and marketing actively communicated the opposite.

Part of an Industry-Wide Failure

The January 29, 2020 recalls were not an isolated response to a single defective product. The CPSC coordinated simultaneous recall announcements against four manufacturers — Delta, Summer Infant, Graco, and Evenflo — on the same day, reflecting a systemic failure across the inclined sleeper category rather than a defect unique to one company’s design.

By the time these recalls were announced, at least 73 infant deaths had been linked to inclined sleepers as a product category. Consumer safety groups noted that some of these products had remained on sale for years despite accumulating warnings from pediatric experts, parents, and consumer advocates — raising serious questions about how long the industry and regulators knew about the risk before action was taken.

Reported Incidents

The CPSC reported no deaths or injuries specific to the Delta Children Deluxe 3-in-1 Activity Rocker, Feeder and Sleeper at the time of the January 2020 recall. The 73 confirmed infant deaths linked to inclined sleepers as a category span multiple brands and manufacturers across the years these products were sold.
