A jury in a San Francisco federal court in August 2018 awarded $289 million to a former San Francisco groundskeeper who claimed he developed non-hodgkin lymphoma from a deadly chemical called glyphosate contained in Roundup weed killer, which is also the active ingredient in Bronco® herbicide.

What is Bronco Herbicide?

Bronco is designed to control weeds in corn, soybeans and grain sorghum (Milo). The weed killer was manufactured by Monsanto until June 2018, when Bayer dug deep into its coffers and purchased the troubled agrochemical behemoth for $66 billion. Roundup, Bronco and the other glyphosate weed killers will continue to be sold and marketed as-is, with the exception of the name ‘Monsanto’ being dropped from the product’s labeling.

What’s the Problem with Glyphosate?

Glyphosate in the most widely used amenity weed killer, according to the Crop Protection Act. In 2012 alone, the glyphosate market was valued at 5 billion, with value projected to continue climbing upwards of $9 billion by 2024.

Along with its widespread use and massive profits reaped by Monsanto, glyphosate has come under the gun in recent years after being linked to multiple severe, potentially fatal side effects. In March 2015, the World Health Organization’s International Agency for Research on Cancer (IARC) declared glyphosate to be “probably carcinogenic” to humans after conducting a year-long study. Results of the study were published in the The Lancet Oncology.

Why Our Law Firm Is Filing Individual Lawsuits Opposed To a Class Action

Although we are a nationally recognized class action firm, the Products Liability Litigation Group at our law firm has decided against the filing of a Bronco Herbicide class action suit and is currently filing individual claims on behalf of injured individuals and/or their family members that have been diagnosed with non-Hodgkin lymphoma after using Bronco or other glyphosate-based herbicide.

It has been our experience in these types of cases that class action lawsuits can be a detriment to many class members, as they are often forced into a blanket “low ball settlement” and higher attorney fees. At Schmidt & Clark, LLP we understand that our clients are suffering emotionally and economically due to loss of wages and/or high medical bills and we plan to maximize each client’s recovery by filing individual Bronco lawsuits on their behalf.
