What’s the problem?
October 13, 2015 – According to an Order issued today by the U.S. Judicial Panel on Multidistrict Litigation (JPML), all federally-filed Zofran lawsuits will be transferred to the District of Massachusetts before Judge Dennis F. Saylor, IV. At the time the MDL was created, only 12 complaints were centralized; however, at least 42 additional claims have been cited as potential tag-along actions eligible for transfer, as well as any new federal lawsuits filed in the future.
The establishment of a multidistrict litigation will allow the docket to undergo coordinated pretrial proceedings, thereby avoiding duplicative discovery and inconsistent rulings by different judges. The consolidation is intended to facilitate judicial efficiency and preserve the resources of the Court, parties and witnesses. The MDL is: In Re Zofran Products Liability Litigation – MDL 2657.
The U.S. Food & Drug Administration (FDA) has approved Zofran for the treatment of post-operative surgery patients and those undergoing radiation or chemotherapy. While it has never been approved to treat morning sickness, an analysis published last year suggested that up to one million American women are prescribed Zofran or its generic equivalent ondansetron for this purpose each year. Lawsuits allege that this widespread practice is the result of improper marketing tactics by GSK, and that the company hid information regarding Zofran’s link to birth defects and failed to warn about this risk.
