What’s the Problem?
April 4, 2017 – There are currently more than 16,000 Xarelto lawsuits pending against Bayer and Johnson & Johnson in the Eastern District of Louisiana. The complaints were all filed on behalf of plaintiffs alleging that the drug caused severe bleeding events, including GI bleeds, internal bleeding, and brain bleeds.
Xarelto is a blood-thinner medication used to prevent the formation of blood clots. The drug was approved by the FDA in July 2011 for the prevention of a type of blood clot called deep vein thrombosis (DVT), which commonly occurs after certain types of surgery.
The problem with Xarelto is that it has no antidote or reversal agent once bleeding events occur. With most other anticoagulant medications, bleeding can be reversed with a single dose of vitamin K.
Initially, 40 Xarelto lawsuits were selected as discovery pool cases. Depositions and written discovery have been completed in those cases. Now, Judge Eldon Fallon has set trial dates for 4 of those lawsuits. All 4 complaints are within Fallon’s jurisdiction, the 5th Circuit which consists of Louisiana, Mississippi, and Texas.
The first bellwether trial is scheduled to begin on April 24, with another beginning each month until July. Bellwether trials are “test” cases intended to move the MDL toward a resolution. Since Xarelto lawsuits involve complex pharmaceutical litigation, each trial could last up to 8 weeks before a jury returns a verdict.
Over the next few weeks, pretrial motions will be filed, and Judge Fallon will hear oral arguments from both parties regarding the admissibility of evidence, exhibits, and testimony. Experts and witnesses will be prepared for trial. This preparation will ensure the bellwether trials will move as efficiently and smoothly as possible.
