What’s the Problem?
Harvey Mahler, plaintiff in the lawsuit, alleges that The Vitamin Shoppe failed to disclose the potential safety risks of “The Vitamin Shoppe One Daily Men’s 50+,” and that the company was negligent, breaching warranties over a defective product for which it should face strict product liability.
Mahler claims that he purchased 2 bottles of One Daily Men’s 50+ male enhancement in June 2017, and soon began suffering from “several new medical problems” including numbness in his extremities, a burning sensation in his feet, hand weakness, slurred speech, headaches, confusion and vision problems. Plaintiff was later diagnosed with severe nerve and kidney damage which required surgery, according to the lawsuit.
Additionally, the complaint states that The Vitamin Shoppe knew or should have known about the potential health risks of its male enhancement pills, and that the company “should have taken steps” to ensure its product was free of harmful substances before putting it on shelves.
Mahler is requesting damages in excess of $50,000, as well as any other relief the jury deems appropriate.
