Distributed by Primavera Nueva Inc. in California and Nevada to retail stores from October 10, 2024 through October 10, 2025. The products have the potential to be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Although healthy individuals may suffer only short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea, listeria infection can cause miscarriages and stillbirths among pregnant women.
Primavera Nueva Inc. voluntarily recalled these products on January 5, 2026 [1]. The recall was initiated after an FDA inspection on October 10, 2025 determined that earlier production records did not consistently verify internal cooking temperatures needed to control potential biological hazards, including Listeria monocytogenes. The products were made with a frozen ingredient labeled “Not Ready to Eat. Must Be Thoroughly Cooked Before Eating.”
Consumers who have tamales with date codes 10/22 (year 2024) through 10/22 (year 2025) should not consume the product and should discard it. Do NOT resell or donate them—it is a violation of federal law to sell or distribute recalled products. No other Primavera Nueva products are affected by this recall.

Potential for a Primavera Tamales Recall Class Action Lawsuit
Consumers who purchased or became ill from Primavera tamales may join a class action lawsuit. Claims could include:
- The tamales were contaminated with Listeria monocytogenes due to inadequate cooking temperature verification.
- Production records did not consistently verify internal cooking temperatures needed to control biological hazards.
- The company failed to ensure products made with ingredients labeled “Not Ready to Eat” were properly cooked.
- Primavera Nueva Inc. sold potentially contaminated food products to consumers.
- Consumers suffered foodborne illness requiring medical treatment.
- Pregnant women may have suffered miscarriages or stillbirths.
- Vulnerable populations including children, elderly, and immunocompromised individuals faced serious health risks.
- Consumers purchased products they must now discard without compensation.
You could get compensation for medical expenses, emergency room treatment, hospitalization, laboratory testing, lost wages, pain and suffering, pregnancy complications, and product replacement costs. While no illnesses have been reported to date according to the company announcement, consumers who become ill after consuming the recalled tamales may be entitled to significant compensation, particularly if they belong to vulnerable populations.
FDA Inspection Findings
During an FDA inspection on October 10, 2025, the agency determined that Primavera Nueva Inc.’s earlier production records did not consistently verify internal cooking temperatures needed to control potential biological hazards, including Listeria monocytogenes. This failure in food safety protocols created the conditions that led to the recall.
According to the company, Primavera Nueva has fully corrected the issue, and enhanced cooking-temperature monitoring and verification have been in place since October 11, 2025. However, all products manufactured before this correction remain subject to the recall.
Listeria Monocytogenes: A Serious Health Threat
Listeria monocytogenes is a particularly dangerous foodborne pathogen because it can survive and even grow in refrigerated conditions where many other bacteria cannot. The Centers for Disease Control and Prevention (CDC) estimates that Listeria causes approximately 1,600 illnesses and 260 deaths in the United States annually.
Listeriosis, the infection caused by Listeria monocytogenes, is especially dangerous for:
- Pregnant women: They are about 10 times more likely than other people to get listeriosis. The infection can cause miscarriage, stillbirth, premature delivery, or life-threatening infection of the newborn.
- Newborns: Listeriosis in newborns can cause blood infections and meningitis.
- People 65 years and older: Older adults are at higher risk for severe listeriosis.
- People with weakened immune systems: This includes individuals with cancer, diabetes, kidney disease, HIV/AIDS, or those taking immunosuppressive medications.
No Illnesses Reported To Date
As of the recall announcement on January 5, 2026, no illnesses had been reported to Primavera Nueva Inc. in connection with the recalled tamales. However, listeriosis symptoms can take anywhere from a few days to several weeks to develop after consuming contaminated food, so illnesses may still emerge.
The voluntary recall is being conducted with the knowledge and cooperation of the U.S. Food and Drug Administration. Consumers who develop symptoms consistent with listeriosis after consuming Primavera tamales should seek medical attention immediately and inform their healthcare provider about their food consumption history.
