What’s the problem?
December 6, 2017 – The jury on Tuesday slapped Bayer and J&J with $26 million in compensatory and $1.8 million in punitive damages, according to Forbes.
The lawsuit was filed by Lynn Hartman, who claimed she was prescribed Xarelto by Dr. Josephine Randazzo in Plymouth, Indiana, from March 2013 to June 2014, at which time she suffered an episode of acute gastrointestinal bleeding that forced her to discontinue treatment.
Plaintiffs brought the following claims asserted in the Xarelto amended master long-form complaint: Strict liability, manufacturing defect, design defect, failure to warn, negligence, breach of express warranty, breach of implied warranty, negligent misrepresentation, fraud and violation of consumer protection laws in both Indiana and Pennsylvania, plus loss of consortium.
The verdict concluded the first Xarelto bellwether case to reach a Pennsylvania state court, whose jury decided after nearly a month of proceedings that bleeding warnings on the labeling of Xarelto (PDF) were inadequate.
The venue has recently seen a flood of cases brought by out-of-state plaintiffs, the majority of which are pursuing litigation through Philadelphia’s Risperdal program. Though verdicts have been somewhat split between plaintiffs and defendants, one plaintiff was awarded a $76 million judgment in a Risperdal gynecomastia lawsuit.
