What’s the Problem?

February 27, 2017 – Plaintiff alleges that he began experiencing severe abdominal pain shortly after receiving an Atrium C-Qur mesh patch during umbilical hernia repair in December 2013. He later learned that the hernia mesh may be the cause of his complications, and in January 2016 underwent hernia patch removal surgery.
However, even after the device was removed from his body, Plaintiff continues to experience pain in the same area, according to the lawsuit.
It was later found that the man had experienced a rare cell reaction to the surgical mesh, the potential for which he was not warned about but was known by Atrium Medical. Plaintiff also claims the manufacturer made false statements to the U.S. Food & Drug Administration (FDA) regarding design changes it made on the C-Qur hernia patch.
The complaint alleges that C-Qur mesh is defective and that Atrium Medical actively hid information about hernia patch complications in an effort to maximize profits.
In December 2016, the U.S. Judicial Panel on Multidistrict Litigation (JPML) consolidated all federal Atrium C-Qur hernia mesh lawsuits in the District of New Hampshire before U.S. District Judge Landya McCafferty. At the time of consolidation, there were at least 21 such complaints pending in federal jurisdictions across the U.S.
